Secondo me no, la garanzia dello stato è l'80% del prestito da 6,3 miliardi, ovvero circa 5.2 miliardi. Per offrire la propria garanzia su questi 5.2 miliardi lo stato chiede che FCA rispetti certe condizioni, a mio avviso molto ragionevoli, e chiede di portare l'investimento in Italia da 5 miliardi a 5.2 per pareggiare la cifra sulla quale offre la garanzia. I restanti 1.1 miliardi del prestito FCA credo li possa spendere come vuole perchè su quelli lo stato non c'entra nulla,  basta che non violi le condizioni per la garanzia statale sul resto del prestito, inclusa la distribuzione dei dividendi.

 

 

Si dovrebbe essere così. Ma e « strana » que quadra con il dividendo di 1.1Md€. Non mi scandalizza comunque che dopo il 2020 si prenderanno certamente il dividendo straordinario, se tutto andra bene e se non ci sarà una crisi epocale.

Questa è facile, non credo che i marchi appartengano a FCA Italy.

esatto: FCA possiede FCA Italy e FCA US, che sono a loro volta proprietarie rispettivamente dei marchi italiani e americani.

sinceramente non vedo cosa altro poteva chiedere il governo.. alla fine si tratta di un prestito e non di finanziamenti a fondo perduto.

Ok la garanzia statale, però le richieste mi sembrano idonee

Certo, ma subito c'è stata l'alzata di scudi di quelli che non vogliono dare i soldi a Fiat bruttaah e kattivaah che porta i guadagni all'estero e prende i soldi dello stato!!1!11!1!

Se c’è stata l’alzata di scudi dalla gente un motivo ci sarà. La brutta reputazione con il popolo italiano loro se la sono cercata.
Se(parlando solo degli ultimi 15 anni) hai presentato 800 piani diversi, in cui tutti giuravi piena occupazione in Italia modelli di qui modelli di la, e non ne hai rispettato uno(anzi stai peggiorando di anno in anno) la merda te la becchi tutta e a ragione.
A prenscindere che sia il primo gruppo industriale italiano ecc ecc

GM and Fiat CEOs Ordered to Meet on ‘Nuclear Option’ Lawsuit

The chief executives of General Motors Co. and Fiat Chrysler Automobiles NV were ordered to meet face to face by July 1 to resolve GM’s lawsuit over bribes of labor union officials by its competitor.

U.S. District Judge Paul Borman, who called the litigation a “a waste of time and resources” and a “nuclear option,” peppered GM lawyers in particular with tough questions on Tuesday in federal court in Detroit.

He then ordered that GM’s Mary Barra and Fiat Chrysler’s Mike Manley talk in person, with social-distancing measures in place, saying the world “has changed dramatically” since the suit was filed in November and citing the pandemic and the national turmoil over racism.

 

Borman acted after more than two hours of oral arguments on Fiat Chrysler’s request to throw out the lawsuit. He said if the case goes forward, there will be “years of contentious litigation” including multiple depositions of company executives and union officials.

“These legalities will not only divert and consume the attention of key GM and FCA executives from their day jobs -- issues of vehicle production and sales and safety -- but also prevent them from fully providing their vision and leadership on this country’s most pressing social justice and health issues,” he said.

The judge grilled lawyers for GM -- asking at one point whether the damages the company is pursuing would decimate one of its main competitors -- while generally allowing the Fiat Chrysler attorneys to make their arguments uninterrupted.

 

“The intent is not to destroy FCA, or whatever you’re suggesting,” said Jeffrey Willian, a lawyer for the plaintiffs. “The idea is for GM to get compensated for the bribery scheme.”

In a statement, GM signaled no intention of backing down from its legal position.

“GM has a very strong RICO case and we look forward to constructive dialogue with FCA consistent with the court’s order,” spokesman Jim Cain said, referring to the Racketeer Influenced and Corrupt Organizations Act.

Fiat Chrysler said it would soon issue a statement on the judge’s order.

Addressing both sides, the judge noted that the U.S. had bailed out both GM and Chrysler following the 2008 financial crisis.

 

“Today our country needs and deserves that these now healthy and great companies pay us back by focusing on rescuing this country from the plagues of racism, Covid-19 and injustice while building the best vehicles in the world,” he said.

GM’s allegations stem from a federal corruption probe that has put nine union and Fiat Chrysler leaders in jail. GM claims that former Fiat Chrysler CEO Sergio Marchionne, who died in 2018, and three Fiat Chrysler executives who have pleaded guilty and been sentenced to prison corrupted the collective bargaining process between the UAW union and Detroit’s automakers, including when contracts were negotiated in 2011 and 2015. That resulted in unfairly high labor costs for GM, it claims.

It also alleges that Fiat Chrysler’s bribes pushed union officials to go along with a proposed merger between the two automakers that Marchionne wanted but GM refused.

Fiat Chrysler Chairman John Elkann has publicly denied the allegations. The company has even said GM may have used the lawsuit to try to thwart its proposed merger with France’s Peugeot SA.

The case is General Motors LLC v. FCA US LLC, 19-cv-13429, U.S. District Court, Eastern District of Michigan (Detroit).

GM sued Fiat Chrysler in November, accusing it of corrupt contract negotiations, which led to higher labor costs for GM. In light of events since then, a federal judge is extremely tired of the suit already.

The judge’s order—for GM CEO Mary Barra and FCA CEO Mike Manley to meet in person and alone—is a good reminder that legal disputes are often only about five or ten percent of actual law and in fact more like regular disputes in real life. Lawsuits are cloaked in legal language—95 pages of it, in GM’s original civil complaint—but it doesn’t follow that resolutions have to be especially complex. That, of course, doesn’t stop some civil proceedings from going on for years at a time, seemingly only to the benefit of the lawyers getting paid to argue them.

Which is just the kind of proceeding Judge Paul Borman foresees happening in the GM-FCA case. On Tuesday, he ordered Barra and Manley to meet in person before July 1 to resolve things, explicitly tying the case to the coronavirus pandemic and the Black Lives Matter movement.

Here’s Borman’s order, issued today in U.S. District Court in Michigan. The order has the tone of an extremely disappointed dad and is worth quoting nearly in full. (The order is embedded at the bottom of this post.)

 

"The world has changed dramatically since this case was filed on November 20, 2019. This city, this state, and this country need healing. The COVID-19 pandemic, and its impact on the health of this country, requires our attention here and now!

Just as important, is our response to the tragic death of George Floyd, that has brought to the forefront the long-standing issues of racial discrimination, and social justice, that require our attention and solution, here and now!

If this case goes forward, there will be years of contentious litigation; motion hearings, multiple-day depositions of large numbers of executives and former executives, at GM and FCA, as well as United Auto Workers (UAW) officials, other Defendants, many third parties, and a plethora of RICO, labor law, and damages experts.

These “legalities” will not only divert and consume the attention of key GM and FCA executives from their “day jobs”—issues of vehicle production, sales, worker safety, roll-outs, supplier issues, etc.—but also prevent them from fully providing their vision and leadership on this country’s most pressing social justice and health issues.

In 2008, and going forward, the Federal Government focused on rescuing GM and Chrysler, by providing billions of dollars in aid. That saved GM and Chrysler, now FCA, and tens of thousands of UAW auto workers’ jobs. Today our country needs, and deserves, that these now-healthy great companies pay us back, by also focusing on rescuing this country and its citizens from the plagues of COVID-19, racism, and injustice, while building the best motor vehicles in the world.

While watching television news, I have seen CEOs Mary Barra of GM, and Michael Manley of FCA join together, time and again (often with Bill Ford) to provide some attention, leadership and skills to solving social and economic issues for the good of their companies, their workers, their communities, and our country.

So too, I have noticed some attorneys devoting their skills to provide equal justice for all citizens, in particular those less fortunate who require representation in our courts.

What a waste of time and resources, now and for the years to come in this mega litigation, if these automotive leaders and their large teams of lawyers, are required to focus significant time-consuming efforts to pursue this “nuclear option” lawsuit, if it goes forward.I am ordering that no later than July 1, 2020, just the two CEOs, Mary Barra and Michael Manley, meet in person (social distancing), to reach a sensible resolution of this huge legal distraction. This will enable you personally, and your companies to fully concentrate, in addition to your “day jobs”, not just through committees, on providing the leadership and vision this country requires, and deserves, in solving today’s aforementioned critical issues.Time is of the essence. So, I repeat; Mary Barra and Michael Manley, meet face-to-face, in good faith, and with good will, to resolve this huge legal diversion, to permit you and your companies to also fully focus your talents on healing this country as we all embark on the critical road ahead."
